Request for Material Test Report Regarding Article 31, Paragraph 1 of Government Regulation No. 4 of 2020 to the Supreme Court

JAKARTA-ASWINNEWS.COM – Anjis Bambang Saputra has filed a lawsuit regarding Article 31, Paragraph 1 of the Indonesian National Police Regulation (Perpol) No. 4 of 2020 concerning the implementation of private security services, accompanied by PWDPI DKI Jakarta and the Legal Aid Institute (LKBH) of Trisakti University. This took place on Thursday, January 23, 2025, at the Supreme Court.

The representatives from PWDPI DKI Jakarta present included its Chairperson, Mayuli Setiawati, as well as Dr. Andi Widiatno Hummerson SH MH, Chairperson of LKBH Trisakti University, and Dwi Alfianto SH MH, Secretary of LKBH, who assisted Anjis Bambang Saputra in submitting the lawsuit and material test request. The focus is on Article 31, Paragraph 1 of Perpol No. 4 of 2020, which regulates the retirement age for security officers, claiming that it creates an unfair distinction between the retirement age of private security personnel and retired TNI-POLRI personnel, which goes against the principles of agreements normally applied in employment contracts.

Anjis Bambang stated that this is a matter of norms and falls under the authority of the Supreme Court, which has absolute jurisdiction on the matter. The issue of retirement age has a demand for equality, and the police do not have the authority to regulate differing retirement ages, which contradicts the Omnibus Law No. 6 of 2023. Dr. Andi Widiatno added that Article 31, Paragraph 1 of Perpol No. 4 of 2020 is considered discriminatory because it leads to unequal treatment between individual security personnel and retired TNI members.

Anjis Bambang further mentioned that he plans to visit the National Police Headquarters (Mabes Polri) to directly inform them about the material test request related to the Perpol. Next week, he intends to meet with the Head of the Legal Division to ensure they understand the context of the request and the freedom in employment relations between employers and employees in private security sectors. Additionally, Anjis stated that they will approach the Indonesian House of Representatives (DPR) to ensure the issue receives legal attention.
