“Waiting for the Decree of the Minister of Home Affairs Regarding the Temporary Dismissal of Luki Hakim, Regent of Indramayu”

Suara dermayu.com released, the Regent of Indramayu, Lucky Hakim, underwent an examination by the Inspectorate General of the Ministry of Home Affairs (Kemendagri) on Monday (7/4/2025) regarding the polemic of his personal trip to Japan, which has attracted public attention.

Lucky arrived at the Ministry of Home Affairs Office at around 17.00 WIB and was questioned for more than two hours.

After the examination, he revealed that 43 questions were asked by the Inspectorate team, regarding the details of his trip abroad.

And quoting the statement of Luki Hakim, Regent of Indramayu:

“I apologize to all Indonesian people, especially the residents of Indramayu. This is purely my fault for not understanding the details of the procedures for permits for regional heads to go abroad,” he said.

From the news, legal facts can be obtained:

First, that it is true that there was a legal incident where Luki Hakim, Regent of Indramayu, had traveled abroad (Japan) without obtaining permission from the Minister of Home Affairs.

Second, the results of the examination were obtained by legal facts by the competent Government Institution qq the Inspectorate of the Ministry of Home Affairs in accordance with Law Number 23 of 2014 concerning Regional Government in conjunction with Law Number 39 of 2008 as amended by Law Number 61 of 2024 concerning the Ministry of State.

Third, Luki Hakim, Regent of Indramayu, has been proven to have legally violated the provisions of Article 76 paragraph (1) letter i of Law Number 23 of 2014, which in full:
*Prohibition of Regional Heads and Deputy Regional Heads and Deputy Regional Heads from traveling abroad without the Minister’s permission.*

Fourth, the sanctions against Luki Hakim, Regent of Indramayu have been clearly regulated in the provisions of Article 77 paragraph 2 of Law Number 23 of 2014, namely, the Minister of Home Affairs is authorized to temporarily dismiss Luki Hakim, Regent of Indramayu, for 3 (three) months.

The provisions in Article 76 paragraph (1) letter i in conjunction with Article 77 paragraph (2) are clear, no interpretation is needed.

Therefore, the Minister of Home Affairs has legal grounds to temporarily dismiss Luki Hakim, Regent of Indramayu for 3 (three) months.
